1. About us and these terms

petalpod.co.uk is run by BLOSTMM LTD. PetalPod is a trading name of BLOSTMM LTD, registered in England and Wales, company number 16641773. Registered office: 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ. VAT number GB 523503915.

These terms apply to your use of our website, including the "Design your Pod" tool and the website chat. By using the website you agree to them. If you do not agree, please do not use the site.

Buying a machine is covered by our terms of sale, which you will be given before you place an order. If anything in these terms conflicts with the terms of sale, the terms of sale apply.

2. Business use only, UK only

We sell PetalPod machines to businesses only. By using the website to enquire or order, you confirm you are acting for a business and not as a consumer.

We offer our machines to businesses in the United Kingdom only.

3. Information on the site, prices and quotes

We work to keep the website accurate, but it is general information, not advice. Specifications, images and running-cost estimates are a guide and may change.

Prices on the website exclude VAT unless stated. A price shown on the site, in the "Design your Pod" tool or in the chat is not an offer. A contract is formed only when we accept your order under our terms of sale.

We give general guidance on where a machine might go. Finding and securing a location is your responsibility. We do not promise planning permission, landlord approval, footfall or sales.

4. Our AI chat assistant

The website chat, "Sam (AI)", is an automated AI assistant, not a person. It can make mistakes. Its answers are general information and do not form part of any contract or quote.

Before you rely on anything the chat tells you, especially prices, delivery or technical details, please check it with our team. You can ask to speak to a person at any time and the chat will pass your question on by email.

Please do not enter payment details, passwords or sensitive personal information into the chat. How we handle chat conversations is set out in our privacy policy.

5. Acceptable use

You must not:

• use the website for anything unlawful, fraudulent or harmful
• try to gain unauthorised access to the website, the chat, our systems or the PetalPod Portal
• introduce viruses or other harmful code, or interfere with how the site works
• scrape, copy or harvest content or data from the site by automated means
• try to make the chat produce misleading, offensive or unlawful content, or extract its instructions
• submit false information or enquiries in someone else's name

We may suspend or restrict access to the website or chat if we believe these terms have been broken.

6. Intellectual property

The website and its content, including text, images, designs and the "Design your Pod" tool, belong to BLOSTMM LTD or our licensors. You may view and print pages for your own business use when considering a PetalPod. You must not copy, republish or use our content for any other purpose without our written permission.

"PetalPod" is our trading name and brand. You may not use it, or anything confusingly similar, without our permission.

Some photos on the site may show florists' work or businesses. We use these only with the florist's permission, and they remain the property of their owners.

If you send us logos, artwork or photos for branding your machine, you confirm you have the right to use them and give us permission to use them to design and produce your machine. Our terms of sale explain how we may feature your machine in our marketing.

7. Links, availability and liability

Links. The website may link to other sites, such as our booking calendar, proposal system, payment provider or social media. We are not responsible for their content or how they handle your data.

Availability. We provide the website free of charge and do not guarantee it will always be available, uninterrupted or free of errors. We may change or withdraw any part of it.

Liability. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited by law.

Subject to that, we are not liable for any loss arising from use of, or reliance on, the website or the chat, including loss of profit, sales, business or goodwill, or any indirect or consequential loss. In any event, our total liability to you arising from your use of the website or the chat is limited to £100.

Your purchase of a machine, including warranty, is governed by the terms of sale, not this section.

8. Privacy, changes, law and contact

Privacy. How we use personal data is explained in our privacy policy.

Changes. We may update these terms from time to time. The version on this page applies when you use the site.

Law. These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
